Terms of Service

Last updated: 12 October 2026

These terms cover your use of the Stravia Marketing website and client portal, and the web design, development, hosting and related services I provide. "I", "me" and "my" mean Owen, trading as Stravia Marketing, a sole trader based in New Zealand. "You" means the person or business using the site or engaging me. By using this site or engaging me for services, you agree to these terms.

I have tried to keep these terms short and in plain English. If anything is unclear, email me before you commit to anything.

Services

I provide custom web design, web development, managed hosting, domain registration, maintenance and support retainers, SEO, and branding for small businesses. There is no upfront price for building a website: I build it first, and once it is live you pay a monthly fee for your hosting plan. Anything we agree in writing for your site (an email counts) sits alongside these terms, and if the two say different things, what we agreed wins for your site.

Project work

Hosting plans

I offer managed hosting plans, priced by the month in New Zealand dollars and billed monthly, or yearly in advance if we agree that. These are the prices for a new client; if a price changes, you hear about it before your next bill.

Every plan includes: Free migration, Free SSL, Uptime monitoring. The features and support response times for each plan are listed on the hosting section of the site.

Changes and support

Your monthly plan covers small change requests after launch, such as text edits, image swaps and minor layout changes. For larger pieces of work, such as new pages or features, I will tell you before starting whether it changes your monthly fee, and any change is agreed with you in writing first. Plans are month to month and can be cancelled as described under Hosting plans.

Domains

If I register a domain name on your behalf, it is registered for you and it belongs to you. While I host your site I manage the DNS for it. When you leave, or whenever you ask, I transfer the domain to you straight away, once you have covered any registration time I have already paid for on it. You are responsible for renewing any domain you register or manage yourself.

Ownership of your website

Client portal

Clients get an account on the client portal to see invoices, raise support tickets and manage their project. Keep your sign-in details private, and tell me straight away if you think someone else has used your account. You are responsible for anything done through your account until you do. I may suspend an account that is being misused.

Acceptable use

You agree not to use my hosting, the portal or any other service to publish or distribute unlawful content, send unsolicited email, infringe anyone's intellectual property, spread malware, or do anything that harms the server or other clients' sites. If I become aware of a serious breach I may take the content down or suspend the service, and I will tell you why.

Liability

I take care with every project, but I am one person running a small business, so my liability has to be limited. To the fullest extent the law allows, my total liability for any claim relating to these terms or my services is limited to the fees you have paid me for the service the claim relates to in the 12 months before the claim arose. I am not liable for indirect or consequential loss, including lost profits, lost revenue or lost data beyond what can be restored from backups.

Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that cannot lawfully be excluded, and nothing limits liability for fraud or for anything else that the law says cannot be limited.

Ending the relationship

Either of us can end a project or an ongoing service by giving the other written notice. If you decide not to go ahead before your site goes live, there is nothing to pay for the work done so far. Monthly plans can be cancelled as described above.

Privacy

How I handle personal information is set out in the privacy policy, which forms part of these terms.

Governing law and disputes

These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction over any dispute. If we do have a disagreement, please talk to me first. Most things can be sorted out with an email or a phone call.

Changes to these terms

I may update these terms from time to time. The "Last updated" date at the top of the page shows when they last changed; the plans and prices above follow the hosting section of the site and change with it. If a change materially affects current clients, I will email them before it takes effect. Projects already under way continue on the terms in place when they started.
