1. Agreement to Terms
By accessing or using any website powered by the Stravia SaaS Platform ("the Platform"), you agree to be bound by these Terms of Service and all applicable New Zealand laws. These terms apply to both the direct users of the Platform and the businesses ("Renters") who license the Platform from Stravia Marketing.
2. Ownership & Intellectual Property
- The Platform: Stravia Marketing retains 100% ownership of all underlying code, database structures (SQLite/JSON), server configurations, and original design frameworks.
- License: Renters are granted a non-exclusive, revocable license to use the Platform to host their business content. This license does not constitute a transfer of ownership of the software.
- Renter Content: Renters retain ownership of the specific text and images they upload, provided they have the legal right to use such content.
3. Platform Integrity & Maintenance
- Design Standards: To maintain professional standards and site performance, Stravia Marketing reserves the right to modify or revert layout changes initiated by Renters that negatively impact the Platform’s core functionality, security, or mobile responsiveness.
- Administrative Access: Stravia Marketing maintains "Master" administrative access to all sites for the purposes of security auditing, data backups, and technical maintenance.
4. Prohibited Activity
Users and Renters may not:
- Attempt to bypass security measures or access the administrative backend without authorisation.
- Use the Platform to distribute spam, malware, or defamatory content.
- Use contact forms to harass third parties or collect sensitive data without proper disclosure.
5. Security & Data Protection
- Encryption: We enforce Forced TLS 1.2+ encryption via AWS SES for all outgoing notifications. We are not liable for data loss occurring on recipient mail servers that do not support modern encryption standards.
- Storage: Data is stored in secure, password-protected environments. While we aim for 99.9% uptime, the Platform is provided "as is."
6. Limitation of Liability
To the maximum extent permitted by New Zealand law, Stravia Marketing shall not be liable for any indirect, incidental, or consequential damages (including loss of profit or data) arising from the use of the Platform or the actions of any Renter.
7. Termination
Stravia Marketing reserves the right to suspend or terminate access to any site on the Platform with 7 days' notice if these terms or the Privacy Act 2020 are breached.
8. Governing Law
These terms are governed by the laws of New Zealand. Any disputes will be settled in the exclusive jurisdiction of the New Zealand courts.
